justice souter

On the Court, Justice Souter’s distinctive personality and vision of law is evident in his opinions. [1]

Justice Souter’s delays in issuing decisions have continued. [2]

In their joint opinion, Justices Souter, O’Connor, and Kennedy signaled the Court’s willingness to tolerate some restrictions on abortion; but they also gave abortion rights a firmer constitutional anchor than ever before. [3]

When Justice Souter was nominated, many viewed him as a traditional conservative. [4]

According to NPR, Supreme Court Justice David Souter is planning to retire at the end of the Court’s term. [5]

A man of unusual and peculiar sensibilities, David H. Souter came to the Supreme Court as a complete enigma. [6]

But the Bush Administration wanted a nominee without the kind of paper trail that had doomed Robert Bork; and Bush felt an affinity for Souter, whom all accounts describe as nice, well-mannered, and thoroughly decent. [3]

If this Court had allowed the State to follow the course indicated by the opinions of its own Supreme Court, it is entirely possible that there would ultimately have been no issue requiring our review, and political tension could have worked itself out in the Congress following the procedure provided in 3 U.S.C. ? 15. [7]

The constitutional views of the Chief Justice of the New Hampshire Supreme Court were largely unknown, and he ran with a bad crowd: his chief Senate sponsor was Warren Rudman (R., N.H.), no friend of judicial conservatives. [3]

As a result, the press labeled him the “stealth justice,” an unknown judge with uncertain values. [...] Souter, who received his nomination to the Court from President George Bush only months after his promotion to a federal appeals court, lacked a public reputation. [6]

But Souter’s life had been dominated by an almost romantic passion for the law, and this commitment, along with his intellectual capacity and character, eventually brought him to national attention. [1]

He also began participation in various civic activities that would eventually lead to trusteeships in both the Concord Hospital and the New Hampshire Historical Society. [6]

Souter’s retirement is not entirely surprising to regular Above the Law readers. [5]

The Court should not have reviewed either Bush v. [7]

david souter

Thursday, April 30th, 2009

David Souter became a Judge of the United States Court of Appeals for the First Circuit on May 25, 1990, having been nominated January 24, 1990. [1]

David Souter was born in Melrose, Massachusetts on September 17, 1939. [2]

When Justice Souter was nominated, many viewed him as a traditional conservative. [3]

A man of unusual and peculiar sensibilities, David H. Souter came to the Supreme Court as a complete enigma. [4]

That same year, after the retirement of Justice William Brennan, Souter was nominated to the Supreme Court. [2]

As a result, the press labeled him the “stealth justice,” an unknown judge with uncertain values. [...] He also began participation in various civic activities that would eventually lead to trusteeships in both the Concord Hospital and the New Hampshire Historical Society. [4]

But Souter’s life had been dominated by an almost romantic passion for the law, and this commitment, along with his intellectual capacity and character, eventually brought him to national attention. [5]

Though he was born in Melrose, Massachusetts, Souter grew up in the town of Weare, New Hampshire on his family’s farm. [6]

Souter, who received his nomination to the Court from President George Bush only months after his promotion to a federal appeals court, lacked a public reputation. [4]

Before that, Souter’s entire professional career, in both private and public practice, had been spent in New Hampshire. [5]

In 1978, Souter was appointed a New Hampshire superior court judge, where he remained for five years. [2]

After law school, Souter went back to his home and accepted a position with the Concord law firm of Orr & Reno. [4]

He then returned to Harvard to attend its law school, graduating in 1966. [2]

Some conservatives advising President Bush failed to realize that a stealth candidate may not withstand the intense pressure of the liberal media after confirmation, a mistake that may have been repeated in the ill-fated nomination of Harriet Miers about 15 years later. [7]
